Terms of Service

These Terms of Service ("Terms") govern your access to and use of AlwaysOn (the "Service"), operated at alwayson.marketing. By creating an account or subscribing, you agree to these Terms. If you do not agree, do not use the Service.

1. What AlwaysOn does

AlwaysOn is an AI-assisted marketing service for small businesses. Depending on your plan, it drafts social media content for your review and approval, and — for Social + Ads subscribers — helps manage advertising campaigns inside your own Meta and Google ad accounts. Some publishing and ad-management functionality depends on approvals from third-party platforms (Meta, Google, TikTok and others) and is rolled out progressively as those approvals clear; the current status of any connection is always shown in your dashboard.

2. Accounts and eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. You're responsible for the accuracy of the information you give us about your business, for keeping your login credentials secure, and for all activity that happens under your account.

3. Subscriptions and billing

AlwaysOn is a paid subscription service — there is no free tier. Plans are billed monthly or annually in advance via our payment processor, Stripe, at the price shown at checkout. Your price is locked for as long as you remain continuously subscribed to that plan.

Cancellation: you can cancel at any time from your account page. Cancelling stops future billing but does not end your current billing period early — you keep full access until the period you already paid for ends, then the subscription does not renew.

Refunds: refund requests are reviewed individually through our refund request form. Submitting a request does not guarantee a refund will be issued.

4. AI-generated content — your responsibility to review

Content drafted by AlwaysOn — social posts, ad copy, captions and similar material — is generated by AI systems based on information about your business. It may contain errors, and it is never published or spent on your behalf without your approval (or, if you've turned on autopilot for a given surface, until you've explicitly enabled that autonomy). You are responsible for reviewing generated content before it goes out, for making sure any claim, price, offer or guarantee it contains is accurate and something your business can honor, and for its compliance with the advertising and platform policies of wherever it's published. AlwaysOn does not guarantee that generated content is accurate, complete, or compliant with any particular platform's rules or any law.

5. Your accounts stay yours

When you connect a social media or ad account, you're granting AlwaysOn permission to act on your behalf within that connection — we don't take ownership of your accounts, pages, ad accounts, pixels, audiences or customer relationships. You can revoke access at any time through the connected platform or by disconnecting it in your dashboard. AlwaysOn never holds or spends your ad budget directly — ad spend runs through your own connected ad accounts, billed by the ad platform, not by us.

6. Acceptable use

You agree not to use the Service to publish unlawful, fraudulent, or deceptive content; to violate the terms of any connected platform (Meta, Google, TikTok, etc.); to attempt to reverse-engineer, scrape, or disrupt the Service; or to use it on behalf of a business you're not authorized to represent.

7. Disclaimer of warranties

The Service is provided "as is" and "as available." We don't warrant that it will be uninterrupted, error-free, or that any particular business outcome (reach, leads, sales, ad performance) will result from using it.

8. Limitation of liability

To the maximum extent permitted by law, AlwaysOn and its team are not liable for indirect, incidental, or consequential damages arising from your use of the Service, including lost profits, lost data, or damage to business reputation from published content or ad spend decisions. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 3 months before the claim arose.

9. Termination

You may stop using the Service and delete your account at any time from your account settings. We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a security, legal, or platform-policy risk to AlwaysOn or its other customers.

10. Changes to these Terms

We may update these Terms from time to time. If we make a material change, we'll update the "Last updated" date above; continued use of the Service after a change means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws applicable in the jurisdiction in which AlwaysOn operates, without regard to conflict-of-law principles, except where local consumer-protection law gives you additional rights that cannot be waived.
